It’s a Matter of Law

NON – PROFIT ORGANIZATIONS
Often you hear of “donating” to a nonprofit
as if that should mean something
warm, fuzzy and beneficial to you. It is beneficial
if the organization you are donating
to is a legitimate non-profit. If a business
is for profit, and if you are a business, you
might still be able to get a tax deduction for
your donation as a marketing expense, but
this is not related to non-profit status.
While non-profits pay no taxes if they
receive income for their stated purpose, they
do pay taxes just like any other business for
“unrelated income.” That means if your
stated purpose is to educate the public on
health and safety and you sell coffee cups
and other merchandise with your logo on
it, you will have to pay taxes on your profits
from the sale of the merchandise. You
wouldn’t pay taxes on income received from
donations that are used to prepare literature
on the topic.
Non-profit organizations are most
often corporations, because being nonprofit
does not mean you are protected from
liability. Non-Profit status is a “tax” status,
not a “liability” status. That is, if you are
an association which is not a corporation,
if your directors receive compensation for
being on the board, then they can be individually
liable if someone sues the association,
whether or not it is non-profit.
Finally, if you want to establish a
non-profit, you must assure that you are
not receiving any personal benefit from
the organization, because otherwise, you
can become disqualified as a non-profit.
For example, suppose a physician opens
a health and wellness center next to their
practice, and they receive referrals from the
health and wellness center. The health and
wellness center could be disqualified as a
non-profit, because the physician received a
personal benefit from the referrals.
