CALIFORNIA’S NEW FORECLOSURE RELIEF LAW
On July 8, 2008, the Governor signed
into law SB 1137 which will spell some
relief for homeowners and tenants whose
homes are in foreclosure.
The new law requires that before lenders
may start foreclosing on a home they
must contact the homeowner to explore
options to avoid foreclosure. This provision
will take effect 60 days from July 8, 2008.
Lenders will have to give notice to
tenants (in 6 different languages) that the
property has been posted for foreclosure
sale.
After the home has been sold in foreclosure,
tenants will be given 60 days to
vacate before eviction may be commenced.
Cities and counties may impose a
$1,000 per day fine on lenders who do not
maintain vacant properties after 30 days
notice.
This new law only applies to loans
originated between January 1, 2003 and
December 31, 2007.
This new law creates a real opportunity
for homeowners to negotiate loan
modifications with their lenders. To date,
many homeowners attempting to contact
their lenders found themselves lost in the
automated telephone lines maintained by
lenders. Under this new law, if a homeowner
has not had contact with their lender
to explore options to avoid foreclosure, the
homeowner will be able to stop the foreclosure
until that opportunity has been given.
For tenants of homes in foreclosure
this law gives advance notice that the home
is in foreclosure and doubles the time tenants
have to vacate after the home has been
sold. No tenant should be paying rent to
their former landlord after the home has
been sold in foreclosure, and as with former
owners, lenders are paying tenants to vacate
homes to avoid the eviction process.

Kalinowski says his children have enjoyed
a turn on the Tumble Time bus,
and he believes the traveling gym is an
excellent family-friendly approach to
traditional kid parties.
“As a council member in Antioch,
I believe this is a great opportunity for
children and a great business idea for
East County, which is full of families,”
said Kalinowski.
And given the current state of the
economy, it’s also an affordable alternative
to the stationary, infl atable party
places, even factoring in the price of
petrol.

than the other gym-type places,” said
