“Don, I’m incredulous that you had
your hands involved in this whole issue from
the very beginning,” said Davis, who actually
meant to say that he believes Freitas has been
involved. “This is unethical, it’s illegal and it is
an abuse of power.
“During these fi nancial tough times for
the city, I am appalled and it’s deplorable that
you, Don, would have something to do with
spending $10,000 of taxpayers’ money to benefi
t directly your campaign for re-election and
your campaign for further offi ces that we all
know you are aspiring for. To use taxpayer
money to benefi t your campaign is wrong,
wrong, wrong.
“As a representative of the taxpayers of
Antioch, I demand here tonight that you repay
the city the $10,000 out of your own pocket or
out of your campaign funds, Mr. Mayor.”
Freitas responded, “Well, Mr. Davis, welcome
to election time. You’re absolutely, positively,
unequivocally lying. I had absolutely

In this environment, males become more
gentlemen. They are more chivalrous; they
respect women more so in this environment.
In addition, they don’t have the distraction of
a young lady (in the classroom).
Another innovation is that the students
will stay with the same teacher for two or three
years at a time. “For some of these young men,
consistency is the huge missing piece of their
life,” said Branch. “If we can give it to them in
the academic setting, they will gain a comfort
level and be able to engage in the learning.”
Many people spoke in favor of the school,
including City Councilman Reggie Moore.
“This is something I think we have needed
in this community for a very long time,” he
said. “I see this as the next natural step in
providing more choice and opportunity in
our community to enhance the quality of life
for all students in this district. I can see where
this charter school would be a great fi t for the
types of things this council is trying to achieve

nothing to do (with it). So tell me what your
proof is.”
Davis said he heard from Nerland that
Freitas had called her after Davis fi led his candidacy
papers to ask her “what she was going
to do about the situation. That’s in direct violation
of the confi dentiality laws of the election
code, sir.”
Freitas responded that that was not a
violation of the election code, adding that he
did talk to the city clerk, who said she would
not allow the “mayor pro tem” designation for
Davis.
“It’s really sad that you’re willing to use
a council meeting for this,” Freitas said. “But
I will be more than happy to discuss this with
you, Mr. Davis. Is this sabotage politics? You
don’t have any issues to run on; you attack my
character. That’s fi ne, Mr. Davis.”
Davis argued that it’s a violation for Freitas
to have a conversation with “our elected
city clerk, who is sworn to uphold the confi -
dentialities of this council” concerning Davis’
in this community.”
The school board members were also
impressed. Claire Smith said that she loves the
uniforms that are planned for the new school:
kindergarten through fi rst-grade students
wear T-shirts; grades two through four wear
polo shirts, grades fi ve through seven wear
Oxford shirts; and grades eight and nine
wear a dress shirt and tie. Smith said it makes
sense to separate boys from girls in schooling
because they learn differently.
Board member Teri Lynn Shaw said
that attending an all-girls high school helped
her focus on her studies. “I’m very proud to
see this here in Antioch tonight,” she said.
“There’s an epidemic on the rise. The child is
failing. It’s scary; it’s really scary. Blessings to
you for your dedication. I commend you on
your effort and tenacity.”
Board member Gary Agopian said he’s
“very impressed” with the presentation. He

Freitas responded, “Mr. Davis, you are
so desperately (trying) to make this a campaign
issue. Congratulations. But you’re really
stretching so far, and you’re embarrassing
yourself and you’re embarrassing this chamber.”
“You may want to say that, Mr. Mayor.
I’ve sat next to you for eight years and you’ve
belittled, you’ve bullied people - and it’s going
to stop,” said Davis, pointing his fi nger at Freitas.
“It’s going to stop this election, sir.”
“You know, Mr. Davis, your tactics are
sad,” replied Freitas. “I don’t think the council
meeting is the proper place for you to do politically
hatchery.”
Davis responded, “At the last council
meeting you brought it up, sir. What was the
difference between then and now?”
At that point Freitas banged his gavel
and announced that the meeting would take
a fi ve-minute break.

Board President Walter Ruehlig was
also impressed by the thorough presentation
and the academic professionalism of the
school’s board of directors, several of whom
have doctorates in education. But he shared
Agopian’s concern that the school be inclusive
of all groups and was concerned that naming
the school RAAMP, which specifi es “African-
American” in its name, might give the wrong
impression.
“I did have some concern and have
received some e-mail about the need for
diversity,” said Ruehlig. “Some did express
dismay, thinking it was going to be limited to
African-American males. I was very delighted

Nerland had tried to break up the têteà-tête
earlier, noting that there currently was
not a quorum present for the meeting. Councilman
Arne Simonsen was absent and council
members Brian Kalinowski and Reggie
Moore had stepped down from the dais when
Davis and Freitas started going at it.
In an e-mail to council members the day
after the meeting, Nerland wrote that she had
told Davis at the Aug. 9 Quality of Life Forum
that the “mayor pro tem” designation
would not be allowed, based on her research
and consultations with election experts.
“When it subsequently became apparent
that Council Member Davis was not going to
accept that determination, I engaged an outside
law fi rm that specializes in election law to
review the matter,” her e-mail states. “I had no
discussions with any Council Member about
whether to engage outside counsel, but chose
to do so because of the highly political nature
of the issue and the potential for litigation
against the City .”

came before us, we encouraged them to do

people think that ‘I’m not welcome.’ (But)
that doesn’t seem to have stopped people
at Antioch Middle School from joining the
club.”
With that, Ruehlig banged his gavel to
close the public hearing. The charter school
application will be scrutinized by AUSD
administrators and a lawyer to make sure it
meets the requirements of the state education
code. It’s scheduled to be voted on by the
board on Nov. 12.
